LocAlley (the “Company” “we”, “us” and “our”) is committed to protecting your Personal Information (as defined below) by ensuring that your Personal Information is treated with care and is not used or disclosed in ways to which you have not consented.  This privacy policy (“Policy”) explains the ways in which we collect, use and disclose your Personal Information.  It applies to any Personal Information that is collected by us, whether it is collected over the telephone, in writing, or electronically.

The Company will never disclose, sell or lease to any third party any Personal Information that you provide to us, including through this website (the “Site”), without your permission, other than as described in this Policy, or unless we are required to do so by law. Notwithstanding this, the Site is hosted and administered by a third party. Accordingly, the Personal Information provided through the Site will be available to that third party for the limited purposes of hosting and administering the Site. 

Although you are not required to register to access our Site, you may be asked to provide us with personal information when you visit certain sections of our Site. By providing us with your Personal Information and using the Site, you accept this Policy and consent to its terms, as well as any other terms that are described to you when your Personal Information is collected.  If you do not consent, please do not use the Site or otherwise provide your Personal Information to us. 

It is the Company’s policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation and/or an individual’s right to privacy are different from one jurisdiction to another. This Policy covers only those activities that are subject to the provisions of Canada’s federal and provincial privacy laws, as applicable.

We may modify, revise or update this Policy at any time by updating this posting. Each time you use the Site, the version of this Policy then posted will apply to that use, so you should check this page each time you use the Site. 

 What is Personal Information? 

“Personal Information” is information about an identifiable individual. Personal Information includes, but is not limited to, your name, residential address, email address, or telephone number.

What Personal Information Do We Collect?

  • Information that you voluntarily provide to us through responses to surveys, search functions, questionnaires, feedback, Tell Your Story forms and the like. We may also ask you to provide additional information such as your email address if you want to obtain additional services, information, participate in a contest or to resolve complaints or concerns.

Personal Information is collected by us when you voluntarily provide it to us, such as when you provide us with your contact information or send us a question or comment through the Site; when you meet with us in person; or when you phone us with an inquiry.

Before forwarding us any Personal Information, please be advised that any information gathered on the Site may be used in the aggregate for research and development relating to the Site and/or for future Site development and, if you ask us to, to send you promotional materials.

Web Beacons

The Site may use web beacons.  When you access certain of our web pages, a non-identifiable notice of that visit is generated.  These technologies usually work in conjunction with cookies.  If you do not want your cookie information to be associated with your visits to these pages, you can set your browser to turn off cookies.  If you turn off cookies, web beacons will still detect visits to these pages, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.

For What Purposes Do We Collect Personal Information?

We collect and use Personal Information primarily for the purpose of:

  • monitoring interest in our range of products and to assist us to tailor the content of the Site to your needs by collecting information about your preferences through tracking of patterns page views on the Site;
  • creating a profile relating to you in order to show you the content that might be of interest to you and to display the content according to your preferences; and

With the permission of an online visitor, information submitted at the time of registration or submission may be used for marketing and promotional purposes by the Company, provided notice of this fact is made available online. If a visitor objects to such use for any reason, he/she may prevent that use, either by email request or by modifying the registration information provided. The Company uses reasonable efforts to maintain visitors’ information in a secure environment. The Company will not disclose Personal Information that you provide on the Site to any third parties other than to an agent of the Company (such as legal counsel, consultants or other representatives) except:

  2. to comply with legal requirements such as a law, regulation, warrant, subpoena or court order, in which case the Company may be required to disclose such information to bodies such as, but not limited to, Canadian and/or international regulatory authorities.

Additional Terms for Certain Websites

The following additional information applies to the Site that requires registration. Generally, you are not required to provide Personal Information as a condition of using the Site, except as may be necessary to provide you with a product or service that you have requested. 

The Site may provide links or references to websites operated by third parties. These third-party websites are not governed by this Policy but by other privacy policies that may differ from this Policy. This Policy does not extend to the collection of Personal Information by these third parties, and we do not assume any responsibility for the privacy practices, policies or actions of third parties. In visiting any third-party websites, whether linked to the Site or otherwise, you do so at your own risk and you assume all responsibility in that regard. We make no representations or warranties regarding, and do not endorse, any third-party website or any content in such website. We encourage you to review the privacy policies of each website visited before using those websites or disclosing any Personal Information to third parties.

Retention and Disposal of Personal Information

We implement security safeguards to protect Personal Information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification, regardless of the format in which the information is held. We have put in place physical, electronic, and managerial procedures to safeguard and help prevent unauthorized access, maintain data security, and correctly use the information we collect online. The Company applies security safeguards appropriate to the sensitivity of the information, such as retaining information in secure facilities and making Personal Information accessible only to authorized employees on a need-to-know basis.

Personal Information you share with us is stored on our database servers at the Company’s data centers (in whatever country they may be located) or hosted by third party service providers used by the Company from time to time. 

Correcting Your Personal Information 

We want to make sure that the Personal Information that we have collected about you is accurate, complete and current.  However, we will not routinely update this information, unless it is necessary for us to do so to fulfill the purposes for which we collected the Personal Information.

Since we generally rely on you to inform us if there have been any changes to the Personal Information that we have collected about you, please let us know if any of this information has changed.
